Abstract

This essay examines Montesquieu’s ideas as an analytical framework for understanding the separation of powers as a safeguard of liberty and a guarantee of due process. Drawing on the Political Constitution of Costa Rica, as well as domestic and international legal frameworks, it develops a comparative classification and analysis of the Costa Rican model alongside the English and French systems. Finally, it aims to provide a document that serves as a guide to understanding how the defense of the separation of powers is closely linked to the protection of the rights, freedoms, and guarantees of the population.
