The Oratory and the Body Language within the Procedural Practice

Abstract

Since some years ago, we have been witnesses of the orality’s development within procedural processes in our country. However, the Costa Rican Law professional is not yet prepared for this new way to create Justice. He cannot stay on the written part, he should learn to defend and litigate in the oral trials. Within the procedural oratory, besides speaking well is talking to persuade, and in that part it must exist a definite Lawyer’s intention to take and learn helping techniques for this trial. On the contrary, the Anglo Saxon World is fully defined because they have effectively studied the speaking procedural mechanisms and they have successfully applied it to the audiences in the courtroom. Taking into account the importance of these techniques, the objective of the present work is to carry on a first critical approach on the area, offering some examples to put into practice in the courtrooms.
