Abstract

Understanding the strengths or weaknesses of orality in Costa Rican Civil Trials is not a simple task, since it is not only a matter of indicating failures, but also offering possible solutions to make the process efficient and effective. It is to avoid the incoherence between the theory and the practice. Not having incoherence between theory and practice, planning and cooperating on this issue is a transcendental matter. The purpose of the present work is to make a study of why it has not been possible to see in practice the theoretical part regarding the orality. We also have the objective to understand which aspects became a vice in order to achieve the relevant recommendation and achieve an efficient and effective practice.
